1. Marketplace and Acceptance of Terms

These Terms & Conditions govern access to and use of BidBuyNext, a United States online marketplace for vehicles and equipment. By creating an account, placing a bid, using Buy It Now, submitting verification information, or otherwise using transaction services, you agree to these Terms and any listing-specific terms presented for the applicable transaction.

2. Eligibility and Accounts

Users must provide accurate and current account information and are responsible for maintaining the security of their account credentials. Certain listing information requires a registered account. Bidding and Buy It Now are available only to users approved as Verified Bidders.

3. Identity Verification

BidBuyNext may require government-issued identification and related information for identity verification, fraud prevention, transaction security, and legal compliance. Verification is reviewed manually and approval may be denied, suspended, or revoked when information cannot be verified or when account activity presents security or compliance concerns.

4. Listings, Inspection and Condition

BidBuyNext provides listing information in good faith based on information available for the specific vehicle or equipment. Vehicles and equipment offered through the marketplace are inspected and serviced by authorized professionals before sale. Buyers should review the listing, inspection and service information, history information, photographs, video, disclosures, and transaction documents applicable to the unit before completing a purchase.

5. Bidding

A bid submitted by a Verified Bidder is an offer to purchase the applicable vehicle or equipment at the submitted amount, subject to listing terms and BidBuyNext acceptance. When a bid is accepted, the buyer is notified and the transaction proceeds to documentation, payment, and applicable pickup or shipping coordination. Bid manipulation, false bidding, or interference with the bidding process is prohibited.

6. Buy It Now

Buy It Now allows a Verified Bidder to initiate a purchase at the displayed Buy It Now price for an eligible listing. Once confirmed, the listing may be placed in Pending status while transaction documents, payment, and delivery or pickup arrangements are completed.

7. Payment

Payments are made by bank wire according to transaction-specific instructions issued through authorized BidBuyNext communications. Buyers should verify payment instructions before sending funds and contact BidBuyNext Support if instructions are unclear, unexpected, or appear to have changed. A transaction is not considered paid until funds have been received and cleared.

8. Shipping, Pickup and Delivery

Shipping terms are established individually for each listing and are displayed with the listing information. Shipping may be included, arranged, buyer-paid, or quoted separately. Carrier availability, geographic limitations, pickup requirements, delivery timing, and transportation charges may vary by transaction.

9. Titles, Ownership and Transaction Documents

Transaction documentation may include invoices, purchase agreements, Bills of Sale, ownership or title-transfer documents, payment receipts, shipping documents, and delivery or acceptance records. Government-issued title, registration, odometer, lien-release, tax, emissions, and other jurisdiction-specific requirements remain subject to applicable law and the issuing authority.

10. Cancellations, Nonpayment and Transaction Issues

If required payment is not completed, verification fails, information is materially inaccurate, or a transaction cannot lawfully or securely be completed, BidBuyNext may place the transaction on hold or cancel it as appropriate. Payment returns, refunds, or alternate-account instructions may require additional identity and account verification.

11. Prohibited Conduct

Users may not provide false information, impersonate another person, attempt unauthorized access, manipulate bids, interfere with marketplace operation, misuse payment instructions, submit fraudulent documents, or use BidBuyNext for unlawful activity.

12. Availability and Disclaimers

Marketplace availability, listing status, pricing, bidding, shipping, and transaction timing may change. BidBuyNext does not guarantee uninterrupted access to the website or that every listing remains available until a transaction is confirmed. Nothing on the website replaces requirements imposed by governmental agencies, financial institutions, carriers, or applicable law.

13. Limitation of Liability

To the maximum extent permitted by applicable law, BidBuyNext is not responsible for indirect, incidental, special, or consequential losses arising from use of the marketplace, third-party carrier services, financial-institution processing, or circumstances outside BidBuyNext's reasonable control. Rights that cannot lawfully be excluded or limited remain unaffected.

14. Changes to These Terms

BidBuyNext may update these Terms to reflect changes in marketplace operations, legal requirements, security practices, or services. The effective date displayed on this page identifies the current version.
